University of Wales to close down after 120 years

120 years after it was founded, the University of Wales (UoW) will shut down. Already comprised of several institutions, two will merge fully while two more will become independent universities.

With a charter from 1893 and the Prince of Wales as its chancellor, problems began at UoW last year after concerns the head of a Malaysian partner institution, a local pop artist, had non-legitimate qualifications. This was followed by Thailand’s authorities denouncing another UoW partner as illegal, then an investigation in the UK into all the UoW’s foreign ties.

The Quality Assurance Agency said UoW’s overseas checks on foreign institutions were inadequate. The UK Border Agency is investigating a possible visa scam whereby foreign students were sold exam answers for a qualification leading to UoW entry and British visas. Two colleges — Rayat London College and Lampton College — are suspended over the claims.

Trinity St David and Swansea Metropolitan universities are to merge, forming University of Wales: Trinity St David. It is to use the latter’s own royal charter, which is itself 190 years old. Newport and Glyndwr are set to become universities in their own right. The dissolution follows calls from the leaders of rival universities for the end of UoW.

“I warmly welcome the historic decision taken today by the University of Wales Council,” said UoW Vice-Chancellor Professor Medwin Hughes, who will fill the same role for the new University of Wales: Trinity St David. “The transformed University will serve and deliver for Wales.” His counterpart for Newport, Dr Peter Noyes, said “The inevitable end to the story of the University of Wales should not detract from a distinguished history lasting 12 decades. Wales should be sad that this day has come[.]” UoW chairmain Hugh Thomas has resigned.

The Prince of Wales is among past students, having spent a 1969 term there. The institution’s various member organisations at one point included the now-separate Cardiff University.

Ikeda Kanako, a 21-year-old senior student of the Meiji Gakuin University and the first daughter of celebrity surgeon Yuko Ikeda, was kidnapped at about 1225 (UTC+9), June 26, 2006, in Shibuya, Tokyo.

A bullet was fired and one officer slightly cut when police stormed a Kawasaki apartment to rescue the girl.

Kanako was dressed in a white light half-sleeved cardigan, blue jeans with a bistre belt made of leather, a spring green camisole and carried a bag of Vuitton when she was abducted at a bus stop.

She was found unharmed 13 hours later by Japanese police at a condominium located in Nakahara-ku, Kawasaki, Kanagawa. The young woman’s make-up was not disordered; Kanako’s long brown fringe was not disheveled at all and she was wearing what she had been when she was kidnapped.

The kidnapping of Kanako was a big story in Japanese media in June, 2006. The story appeared in many newspapers as the front-page news on June 27, 2006.

Kanako and her kidnappers had been in touch with her mother using Kanako’s mobile phone. The effort to free her was helped greatly by a woman who witnessed the moment Kanako was taken; she wrote down the license plate of the van and other details.

Police traced mobile phone calls and were able to locate the van in Kawasaki where they detained two of the kidnappers as they went shopping.

One conspirator Li Yong, 29, from China, led the policemen to the apartment and tricked Kaneo Ito, 49, from Japan, to open the door. Ito managed to discharge one bullet before being restrained by an assistant police inspector, the first man in the room.

The other man involved in the kidnap of Kanako was Choi Gi Ho, 54, from South Korea. Kanato was freed unharmed.

The Tokyo Metropolitan Police Department arrested three men on suspicion of conspiring to kidnap a woman and hold her to a reported 300 million yen ransom.

A medical helicopter crashed into a fence just outside a house in Tucson, Arizona on Wednesday afternoon, killing all three crew members on board. The crash occurred at 1:42 p.m. Arizona time (21:42 UTC) at the intersection of Glenn Street and Park Avenue. Eyewitness Ricardo Carrasco said that he saw the rotors stop working and the helicopter start plummeting towards the ground, with the pilot attempting to steer it away from the house.

According to the Federal Aviation Administration, the helicopter was a Eurocopter AS350B3 flown in the LifeNet Arizona fleet. It was operated by the Colorado-based Air Methods Corporation, which specializes in flying emergency medical helicopters.

“This is a sad day for all of us at Air Methods and we extend our heartfelt sympathy to the family and friends of our employees who perished while on duty,” Air Methods Corporation CEO Aaron Todd said after the crash.

Two other fatal aviation accidents were reported in the United States on Wednesday. In Alaska, a United States Air Force C-17 Globemaster transport plane crashed while preparing for an air show, killing all four crew members. Earlier, Delaware, Ohio city councilman and airport commissioner James Moore died when his rented light plane crashed and caught fire close to the city’s airport.

“Communism was much better,” said Tsahiriin Daariimaa Saturday on the eve of Mongolia‘s presidential elections. Polls predict that many Mongolians plan to vote for their former communist rulers — the Mongolian People’s Revolutionary Party (MPRP).

Under communism, “everyone worked for the collective farm,” Daariimaa said. None of her children has a steady job these days.

Myatav Choijav is a Mongolian who shares that view; “Now, some people are very rich and some are very poor. In the old times, the government took better care of us ordinary people,” Choijav said. “Now, the government is very far away from us, especially if you live in the countryside and take care of sheep. Everyone was equal under communist rule,” Choijav said.

Tseveenjav, a 70-year-old sheep herder, agrees: “I will support the MPRP. They always do the right thing.”

Tseveenjav wears the traditional Mongolian thick boots and hat while sitting upon his horse with a dead marmot hung from his saddle. Falcon and Tiger, his sheepdogs, help him keep watch over 500 sheep.

Sambuu Ganbaator, a member of the Democratic Party, has a different opinion from most of his neighbors.

“Too many people forget what the MPRP did to Mongolia,” he said. “They kept Mongolia under a brutal dictatorship. You weren’t allowed to speak your mind.” Now, he said, “you can say anything you want to say and do what you want to live a happy life.”

The MPRP’s candidate, Nambariin Enkbayar, leads the polls and the ex-communist party has said that it is now committed to democracy.

On the 11th August, the former Prime Minister of Japan Riyutaro Hashimoto, age 68, formally indicated he would not run for the Okayama 4th constituency of the House of Representatives, the Lower House of Japan, due to defectiveness of his physical condition, possibly nominally. Since the current prime minister Junichiro Koizumi had resolved that House, an election will be held on September 11.

The next day of that announcement, on the 12th, the Liberal Democratic Party (LDP) executive committee showed they had no intention to recognize him as a candidate to proportional representative constituency. There might be no possibility for him to run for the coming election as the LDP candidate and his political career would inevitably end.

On the July, 2004 it was reported that Hashimoto did not state the donation of 1 hundred million yen from a lobbist organisation in the annual political financial income and outgo report, which is legally mandatory to all minister and parliament speakers. Hashimoto had received that donation from the Japan Dental Political Federation, one of his main supporting organisations. His relation between medical and pharmacy lobbyists began at least in 1963 when he was appointed as a secretary of Minister of Health and Welfare. In the same year, he ran for a constituency for which his father had run since his death in that year. Later he was appointed to the Minister of Health and Welfare and played a roll as the representative of this ministry during his career.

Hashimoto had been a speaker of the House of Representatives since September 1963. He had not lost his seat until now. He was appointed to the Minister of Health and Welfare, and the Minister of Industrial Minister successively. He was the president of the LDP from 1995 until the party lost at the election of the House of Councillors in 1998. He was also the Prime Minister of Japan from 1996 till his resignation from LDP presidency. In 2001 he ran again for the presidency of the party, but was defeated by the present Prime Minister Koizumi Junichiro.

The Thanksgiving season is upon us and just a few days from now, most US citizens will be traveling too far on the worst travel day of the year, to see family they’d rather not spend an afternoon with and will likely see again in another month, and eating far more than they should of some of the best food they’ve ever tasted on what is a uniquely American holiday.

And while the cynics among us have hit a fever pitch with their decrying of the commercialization and corporate marketing rollouts that have been growing in waves for the last decades, it remains that Thanksgiving is a top holiday for many US citizens.

Of the Big Five, (Easter and July 4th plus the fall triumvirate of Halloween, Christmas, and Thanksgiving) was there ever a question. The three main reasons – least commercialized, most bang for the buck, and one of the 3 times of real reflection all year. Thanksgiving falls right in the middle of the peak shopping season and therefore can’t escape being part of the marketing blitz. In fact, the day after Thanksgiving is always one of the busiest shopping days of the year. However, the day of Thanksgiving itself has remained largely untouched by Madison Avenue, except for the necessary foodstuffs, in comparison to Easter, Fourth of July, and certainly Halloween and Christmas. Easter and Christmas marketing efforts are weeks long in preparation and fireworks spending is also remaining strong. And Halloween is a short-lived holiday that many kids look forward to, but parents dread – not only for the candy that remains but the late dark night and weeks of candy-grubbing afterward.

Thanksgiving, though, has remained true to it’s roots – a time to be with loved ones, eat good food, and travel as much as you visit. As far as bang for the buck, though, nothing beats it. While many begin turkey preparations up to a week ahead of time, the overall preparation is simple. Just show up and start eating. I mean, you’ve got to eat anyway on the last Thursday of November. But you certainly don’t have to look for eggs, light dynamite on fire, buy 10x too much candy, or do everything people do around Christmas – yet we all do it. Thanksgiving has stayed true to its origins and provided much satisfaction for a relatively easy investment of time, money, and effort. And even if you are the host or cook for the year, other family are always willing to chip in.

Finally, Thanksgiving truly is a time to sit back and consider what you have to be grateful for. In fact, many families include a time around the dinner table to talk about what they have and are grateful to have. And besides one’s birthday and New Year’s Day, there is no other specific time during the year when everyone is reflecting collectively. So while the shopping season will hit it’s fever pitch shortly after Thanksgiving and many will start stressing out over the few pounds, consumer spending, and family interactions they’ll take over the next month, Thanksgiving will still remain the Last Great Holiday.

On Wednesday, Martin Harrington and Thomas Leonard, songwriters of the song Amazing performed by Matt Cardle in The X Factor six years ago, claimed British singer Ed Sheeran copied it ‘note-by-note’ in his 2014 single Photograph.

The duo claimed there are 39 identical notes in both the tracks and they seek about US$20m (about 17.8m euros) and royalties from their song in settlement.

Matt Cardle, performer of Amazing, denied his partipitation in filing the lawsuit. He tweeted, “Please read news articles closely. This is not my lawsuit. I think Ed Sheeran is a genius & 100% deserves all his success”.

Photograph, the fifth single of the album x, has more than 208 million views on YouTube and has been purchased 3.5 million times. The song was featured in Hollywood romantic movie Me Before You.

The hearing is to take place in federal court in California and Richard Busch is to represent the duo.

Canberra’s Sophie Lavers crowned Miss World Australia

Sophie Lavers, a 24-year-old woman from Canberra, has been crowned Miss World Australia in Sydney. She defeated nineteen other finalists to take the prize and will represent Australia at the Miss World event in South Africa.

The entrants were judged based on several categories including best talent, healthy body image, sports and fitness and beauty with a purpose. An aspiring actress, she is completing an acting course and hopes to build a career in film and television. She is also a qualified fitness instructor and has worked as a Kings Cross waitress.

She has been described in the media as having an “amazing figure” and it has been rumoured that she has used this for modelling work. However, Lavers has said that her body has only been modelled for a good cause: “Some do think that, but I have only ever modelled for charity.”

She also doubts much will change for her, at least in the near future. “I’ll still get up and probably have peanut butter on toast for breakfast but after that I’m not sure what’s happening. I guess I won’t be going to work tomorrow.”

She explained that all the girls who entered were dedicated to making a difference. “I just think it’s like having little angels out there through the country helping in all different areas whether it’s with children, or blind people, or the homeless.” Lavers also complained that non-stop smiling for the event has left here mouth sore. “I’m not used to smiling for hours on end.”

Lavers is now set to head to Johannesburg for the December 12 global competition. “I’ve got to get a month of outfits ready and get a talent and another speech and everything. Oh goodness.”

Third Party Beneficiaries

Nothing contained in this Agreement shall be construed to confer upon any individual or entity other than the parties hereto any rights, benefits or causes of action, except as expressly set forth in this Agreement.

This prevents a non-party from suing a party as a ‘third party beneficiary’.

Relationship Between the Parties.

The parties to this Agreement are independent of each other, and nothing contained herein is intended to create a relationship of partnership or joint venture between them. This Agreement be not be construed to create any relationship between the parties hereto except as expressly provided herein.

This prevents a party being held liable for the acts of another party.

Effective Date; Merger

This Agreement shall take effect on ____________________. This Agreement constitutes the entire agreement between the parties hereto with respect to the subject matter hereof and supersedes all prior discussions, negotiations and agreements between them.

This prevents any party from asserting that there was a separate simultaneous or prior agreement that changed the terms of this Agreement.

Modification

This Agreement may not be modified except by written instrument signed by both (all) parties.

This prevents any party from asserting an oral amendment of the agreement and attempting to use verbal testimony (perhaps his own) to try to prove it.

Severability

The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision.

This prevents a court from declaring the entire agreement void to a single invalid provision. Only the invalid provision is removed, and the rest of the agreement remains binding and enforceable on the parties.

The point of all this, of course, is not only to win a court battle but also to clarify matters so that you won’t end up in court (and to prevent a legally savvy party from trying to pull a legal ‘dirty trick’ on you!).
